Kirk Ogrosky


Kirk Ogrosky leads the Department of Justice (DOJ), Criminal Division’s health care fraud enforcement activities.  As Deputy Chief in the Fraud Section, he is the senior prosecutor in the Division dedicated to criminal health care fraud enforcement.  He coordinates with U.S. Attorney’s Offices, the FBI and the Department of Health and Human Services, Office of Inspector General (HHS-OIG).  Prior to DOJ, he was counsel with the law firm of Skadden, Arps, Slate, Meagher & Flom, and was an A.U.S.A. in Miami.

Mr. Ogrosky supervises teams of prosecutors handling cases around the country.  In 2006, he created the Medicare Fraud Strike Force (MFSF).  He supervises MFSF operations in Miami, Los Angeles, Detroit, Houston, New York, Tampa and Baton Rouge.  In less than three years, the MFSF has brought cases against over 500 defendants involving over $1.1 billion in charged false claims. In February 2009, Congressional Quarterly said that he had “turned conventional white collar prosecution on its head” in the world of health care fraud through the creation of the MFSF. Mr. Ogrosky was part of a group that created the Health Care Fraud Prevention and Enforcement Action Team (HEAT).  He currently serves on multiple HEAT committees including Operations, Data, & Pharmaceutical Enforcement.

In the last two years, Mr. Ogrosky successfully tried six Medicare fraud cases to verdict. Over his career, he has taken 36 defendants through trial to jury verdict in cases involving kickbacks, false claims, upcoding, cost report fraud, tax evasion, money laundering, among others.  He co-leads the Department’s recently announced Foreign Corrupt Practices Act (FCPA) initiative focused on pharmaceutical and device manufacturers.

Mr. Ogrosky has experience with both criminal and civil investigations of physicians, hospitals, academic medical centers, managed care organizations, insurers, pharmacies, pharmaceutical and device manufacturers, home health agencies, skilled nursing facilities, independent diagnostic testing facilities and rehabilitation facilities.

Mr. Ogrosky serves as an adjunct professor of law at Georgetown University in Washington, D.C..  In 2008, he served on the Board of Directors for the National Health Care Anti-Fraud Association.  For his work combating fraud, he has been awarded the Attorney General’s Award for Distinguished Service in 2008, the Assistant Attorney General’s Award for Special Initiative in 2007, the EOUSA Director’s Award for Superior Performance as an AUSA in 2003, and the HHS-OIG Integrity Award.

Mr. Ogrosky graduated from Washington University in St. Louis and The George Washington University Law School in Washington, D.C.  While in law school, he served as a Notes Editor for The George Washington International Law Review.  He clerked for United States District Judge Patricia A.
